Terms of Use

These Terms of Use (“Terms”) govern your use of Radiolive (the “App”), an iOS application owned and published by Rue S.r.l. (“Rue”, “we”, “us”). They apply in addition to Apple’s own terms for the App Store.
1. Acceptance of Terms
By downloading, installing or using the App, you accept and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Licence to use the App
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on devices you own or control, for your own non-commercial use, in accordance with these Terms and with the App Store Terms of Service.
You agree to use the App only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the service. You may not reverse engineer, decompile, resell, redistribute or create derivative works from the App, except to the extent that applicable law expressly permits it.
3. Radio streams and third-party content
The App gives access to radio stations and podcasts operated by third parties. That content is not ours: it is provided by broadcasters and content owners, who are solely responsible for it and for its availability. When you play a stream, your device connects to the broadcaster or its provider, whose own terms and privacy policies apply.
Catalogue coverage, station availability, stream quality and podcast episodes may change or become unavailable at any time, without notice, for reasons outside our control.
4. Subscriptions and auto-renewal
The App offers optional auto-renewing subscriptions that unlock premium features. The following applies to all subscriptions:
- Payment is charged to your Apple ID account at confirmation of purchase.
- The subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
- You can manage your subscription and turn off auto-renewal in your Apple ID account settings after purchase.
- Where a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription, where applicable.
- Prices, plan durations and trial availability are shown in the App before purchase and may vary by country and over time.
Subscriptions are sold and processed by Apple. We do not receive or store your payment details.
5. Refunds
Purchases made through the App Store are handled by Apple, and refund requests are decided by Apple under its own policies. We cannot grant, refuse or reverse a refund.
If you request a refund, Apple may ask us for information about how the purchase was used. How we respond, and how you can opt out, is described in section 5.6 of our Privacy Policy.
If you are a consumer in the EEA or the UK, statutory withdrawal and conformity rights apply in addition to Apple’s policies and are not limited by these Terms.
6. Advertising
The free version of the App is supported by advertising. Ads are served by third-party providers as described in our Privacy Policy, which also explains the choices available to you regarding interest-based advertising.
7. Intellectual property
The App itself, including its software, design, trade marks, logos and graphics, is the property of Rue S.r.l. or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any such right to you. Rights in third-party content available through the App remain with their respective owners.
8. Availability and changes to the service
We may change, suspend or discontinue the App, or any of its features, at any time. We may also release updates that modify or remove functionality. We will not be liable to you for any such change, except where the law provides otherwise.
9. Disclaimer
The App is provided “as is” and “as available”, without representations or warranties of any kind, express or implied, to the fullest extent permitted by law. We make no representation or warranty as to the accuracy, completeness or continued availability of the content accessible through the App.
Nothing in these Terms excludes or limits any right you have as a consumer under mandatory provisions of applicable law.
10. Limitation of liability
To the fullest extent permitted by law, Rue S.r.l. shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your access to or use of the App. Nothing in this section limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
11. Governing law and jurisdiction
These Terms are governed by the laws of Italy. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Bologna, Italy. If you are a consumer, this does not deprive you of the protection of the mandatory rules, or of the right to bring proceedings in the courts, of the country where you are resident.
12. Changes to these Terms
We may modify these Terms at any time. Changes take effect when the revised Terms are posted on this page and the “Last updated” date is changed. Your continued use of the App after that constitutes acceptance of the modified Terms. Where the law requires it, we will provide additional notice.
